We have over 30 years investigating experience, including investigating as a Police Officer. We have good knowledge of the system, legislation, and evidentiary requirements, possibly better than some Police, looking at the briefs that come across our desk. Often a Police investigation is sketchy. They tend to zone in on one suspect, and forsake all other possibilities. Their objective is to prove the elements of the offence beyond reasonable doubt. A court isn't about truth, guilt and innocence, it is about what can be proved or inferred, what evidence is acceptable, and the precedent in a case. The burden of proof generally rests with the Police (although in an ever widening number of cases, once a low standard is reached the onus of proof can switch). To prove that you didn't do, or say, something can be harder than proving you did, under some circumstances.
Community attitudes also play a part, in a jury trial; here, if the charged offence is topical, and community outrage stimulated, the jury tends to convict more easily, on less evidence; it can also lead to demands for a longer sentence, than the Penalty and Sentences Act, and precedence, suggests. This can sometimes mean the Police proceed with a charge, when the evidence is deficient; it can also mean, in some cases, an appeal is justified. Courts do make mistakes, and unsafe convictions should not stand.
