We have over 30 years investigating experience, including investigating as a Police Officer. We have good knowledge of the system, legislation, and evidentiary requirements, possibly better than some Police, looking at the briefs that come across our desk. The Police are hampered by directions, and guidelines, that go against what most would understand as justice. The standard of investigation seems to have fallen; we have had some great successes, helping people negotiate their way through the system.
We need something to work with, to investigate, we need the accused to be available, to be able to work out a timeline, to find out where to search for information, witnesses, exculpatory evidence. We can either be engaged by the solicitor, or engaged directly by the accused, the defendant. For criminal matters there may be a Police Brief available, setting out what is alleged. There may be a complainant statement giving more detail. We may need to take an affidavit from the complainant. These are relevant to the investigation. Contacting us the day of the trial, when you have your court hearing, is insufficient notice.
Having a client who is innocent is good, being able to show that they are innocent, that the criminal standard can't be reached, is better. Yes, innocent people get convicted; yes, guilty people go free. The court system is imperfect. We are a Townsville criminal defence investigation, Townsville criminal defence investigator, Townsville private investigator service. We follow the evidence. We get out and search for evidence, for witnesses, for information; a solicitor waits for it to be delivered. For court, a good solicitor is essential.
Often a Police investigation is sketchy. They tend to zone in on one suspect, and forsake all other possibilities. Their objective is to prove the elements of the offence beyond reasonable doubt. A court isn't about truth, guilt and innocence, it is about what can be proved or inferred, what evidence is acceptable, and the precedent in a case. The burden of proof generally rests with the Police (although in an ever widening number of cases, once a low standard is reached the onus of proof can switch). To prove that you didn't do, or say, something can be harder than proving you did, under some circumstances.
Community attitudes also play a part, in a jury trial; here, if the charged offence is topical, and community outrage stimulated, the jury tends to convict more easily, on less evidence; it can also lead to demands for a longer sentence, than the Penalty and Sentences Act, and precedence, suggests. This can sometimes mean the Police proceed with a charge, when the evidence is deficient; it can also mean, in some cases, an appeal is justified. Courts do make mistakes, and unsafe convictions should not stand.
We also investigate in the related areas of traffic accident investigation, and civil case investigation (where the standard is generally a lower one, of the balance of probability). When you need your matter investigated contact us for a free quote. You suspect, we investigate and report.
